As part of the HR Check-Up provided by Titan Group, a mini employment law session is presented. During the last couple of these sessions it occurred to me that this information is not provided in any venue or forum that I have ever come across during my 20 years as an HR practitioner, except in my course work to prepare for my PHR and SPHR exams.
This mini session does not just review the top 7 federal laws we all see mail advertisements for, i.e., Title VII, ADA/ADAAA, ADEA, Equal Pay Act/Lilly Ledbetter Act, FMLA, FLSA, and the Pregnancy Discrimination Act; and of course let us not forget the state Workers’ Compensation Act advertisements. The mini session the Titan Group provides reviews the vast majority of the pertinent federal employment laws (total of 57), all pertinent Virginia state laws (total of 41), and other charges that can be brought against a company or individual in civil or criminal court regarding employment actions (total of 26). Almost 125 laws or charges in total; over 115 laws a small to mid-sized employer may not even know exists, but are required to know – or should have known – about, according to the courts.
Spending an 8-hour day reviewing employment law may seem to some pure agony, but not knowing may be more of a headache, not only physically but monetarily as well! My suggestion to all is to take the time to know what is required of you by the government in order to ensure your company is not taking unnecessary risks, which in the end may cause preventable liability.
